Determining Custody and Access

In many instances, coming to a resolution outside the courtroom regarding both custody and access is encouraged. If parents cannot reach a resolution, the courts will determine the outcome by deciding what is in the best interests of the children. This may include a psychological assessment or working with professionals such as psychologists. The courts will also examine such things as the age of the children, the relationship with each parent, parental involvement and other circumstances.

Child Support Guidelines

Child support and Section 7 extraordinary expenses are calculated based on Federal Child Support Guidelines, what is in the best interest of the children and the income of the parents. The courts will look at the Custody and Access arrangements and the number of children. Each situation is different and the Guidelines are not absolutely determinative. At first instance, if one parent has the children 60 percent of the time that parent will be entitled to full child support; However, there are other factors that might determine the support payments.
